Delhi High Court upholds Arvind Kejriwal's position

The Delhi High Court has declined a petition seeking the removal of Arvind Kejriwal as the Chief Minister of Delhi. This decision comes after Kejriwal's arrest in the liquor policy case, where he is currently in Tihar Jail. 

Petition dismissal

The court stated that it is Kejriwal's personal decision whether to continue as CM or not.This is the second petition aiming to remove Kejriwal as Delhi CM that the High Court has rejected. The court advised the petitioner to address constitutional authorities for such matters, emphasizing that personal interests should sometimes yield to national interests.

Court's stand

"We are a court of law. Do you have any precedent where the President's rule or Governor's rule has been imposed by the court?" questioned the bench. The court underlined that the decision lies with the Lieutenant Governor (LG) or the President, stating that the LG is fully capable of deciding on such issues without the court's intervention.Vishnu Gupta, the petitioner and national president of the Hindu Sena, withdrew the petition. He expressed intent to present his case before the Lieutenant Governor.

After Kejriwal's arrest on March 21, the petitioner highlighted a perceived "lack of government" in the capital. However, the court reiterated that the LG is empowered to make decisions regarding governance. The High Court's stance remains clear: the matter of Kejriwal's position as CM rests with the constitutional authorities, not the judiciary.
